Announcement: The NSW Government recently introduced the Electronic Transactions Amendment (COVID-19 Witnessing of Documents) Regulations 2020 which allows you to sign your Will in the presence of your witnesses by audio visual link. The Regulations also allow Lawyers to electronically sign the Enduring Power of Attorney and Enduring Guardianship documents this way, ensuring the safety of our clients and staff is maintained during the current pandemic.
Do you have a valid Will? Many people mistakenly believe so.
An invalid Will could create uncertainty and quite possibly result in your estate being distributed in accordance with a pre-determined formula as opposed to your express wishes.
If you have been putting off making or updating your Will because of complex family dynamics, then we can discuss a range of estate planning needs, including testamentary trusts which allow you to secure assets for your children whilst still providing for your spouse during their lifetime. There are other complex estate planning options such as a special disability trust if you have a disabled child and want to ensure they are well provided for.
As part of our estate planning, we will review any death benefit nomination as part of your superannuation, including any life policy.
We offer fixed price Wills, Enduring Powers of Attorney and Enduring Guardians.
If you have not been adequately provided for in a deceased’s estate, then we can provide you with supportive and sympathetic advice and guidance as to your rights to challenge.
